Data Protection

Pursuant to current legislation on personal data protection, the Board of Directors of Patrimonio Nacional (CAPN) hereby informs you that the personal data provided by you when filling in the electronic forms that appear on this website, as well as those you provide via email, as a result of your queries, complaints, suggestions, congratulations, offers, requests or contracting of services or products shall be processed electronically and collected in a data file.

The main objective of the personal data processing is to establish and and maintain the relationship between the parties, based on the Legal System Applicable to the Public Sector and and the legislation that regulates the functions of the CAPN. The data provided by you may be processed in each case to manage queries, complaints, suggestions, congratulations, customer care, media matters, queries to the Library, the General Archive and related services; to keep you informed of current events and educational activities; and to manage visits and activities, booking activities and ticket sales.

In the event that you have requested any service and have granted us your authorisation, our communications are based on the legitimate interest of keeping you informed of our services, pursuant to current legislation on electronic communications.

We also request that you inform CAPN of any changes to your personal data so we may always keep the information in our files up to date and free from errors.

Data Storage

The Board of Directors of Patrimonio Nacional (CAPN) carries out its activity on an ongoing basis and informs you that the processed data shall be kept for as long as there is a contractual relationship or regular communication. Said data shall be destroyed once the legal terms in force that govern commercial and tax relations have expired, or you legitimately exercise any of your rights.

Rights

Data subjects have the right to access their personal data, as well as to request the correction of inaccurate data or, where appropriate, to request their deletion when, among other reasons, the data is no longer necessary for the purposes for which they were collected.

Provided that it does not contravene the applicable legislation in force or contractual agreements between the parties, data subjects may request limitation of the processing of their data, in which case we shall only keep them for the exercise of or defense against claims, management of conflicts between the parties, or the effective maintenance of the relationship between the parties.

CAPN shall stop processing the data and shall hold them exclusively in a locked state in order to meet legitimate compelling reasons, the exercise of or defense against possible claims, or to comply with current legislation.

CAPN informs you that you have the right to lodge a complaint with the Spanish Data Protection Agency.

Legitimate Basis

Your data is processed under the legitimate basis of attending to your requests for consultations, complaints, suggestions, congratulations, offers, requests or contracting of services or products, as the case may be.

Notifications for the purpose of information are based on the consent that is requested, without the withdrawal of this consent affecting in any way the execution of any contracts between the parties or to attend to requests or queries made by the interested party.

Recipients

Personal data provided by you to us in order to respond to your consultations, complaints, suggestions, congratulations, offers, requests or contracting of services or products, shall not be disclosed to other institutions without requesting your prior consent.

Personal data considered special category data shall not be disclosed to third parties, unless expressly stated in the specific terms and conditions of the contracted services.

Origins of the Data

The personal data processed by us is derived mainly from data subjects and from business or contractual relationships. If the data does not proceed directly from the data subject or if the processing is not compatible with the existing purposes, we shall ask for your prior consent regarding the new processing.

CAPN hereby informs you that it has implemented the necessary technical and organisational security measures to ensure the security of your personal data and to avoid its alteration, loss, treatment and/or unauthorised access, taking into account the state of technology, the nature of the data stored, and the risks to which they are exposed, whether from human action, or from the physical or natural environment.

The user’s disclosure of data by the means provided implies the acceptance of these clauses, which are necessary to establish and maintain the relationship between the parties.

Our data protection policy may be amended due to possible changes in legislation or the criteria of the Spanish Data Protection Agency, but in any case, these amendments shall be necessary to adapt our policy to the legislation in force and to the user and customer protection criteria.
